Terms of Use

These terms govern use of the Safar Nova website, app, and services. By accessing the Services, you are deemed to agree to the following.

1. Legal basis & scope

These Terms of Use are based on the laws of the Republic of Indonesia, including but not limited to:

  • The Indonesian Civil Code (KUH Perdata) on obligations and contracts;
  • Law No. 11 of 2008 on Electronic Information and Transactions as amended by Law No. 19 of 2016 and subsequent amendments (“ITE Law”);
  • Government Regulation No. 71 of 2019 on the Operation of Electronic Systems and Transactions (“GR 71/2019”);
  • Law No. 27 of 2022 on Personal Data Protection (“PDP Law”);
  • Law No. 8 of 1999 on Consumer Protection, to the extent relevant.

These terms apply to the website, pilgrim app, agent dashboard, API, and related Safar Nova services (the “Services”), and are complemented by the Privacy Policy.

2. Definitions

  • Safar Nova / We: the provider of the pilgrim app and umrah/Hajj field monitoring platform Services.
  • User / You: an individual or business entity accessing or subscribing to the Services (including travel owners, branch agents, and pilgrims).
  • User Content: data, text, location, messages, uploads, or other materials you enter into the Services.
  • Electronic Contract: an agreement made through an Electronic System as referred to in the ITE Law and GR 71/2019.

3. Acceptance & validity of electronic agreements

By registering, signing in, clicking to agree, or using the Services, you state that you have read, understood, and agreed to these Terms of Use and the Privacy Policy. That agreement is a meeting of the minds in the form of an Electronic Contract / electronic contractual arrangement recognized under the ITE Law and Article 46 of GR 71/2019, provided the requirements for a valid agreement under Indonesian law are met (consent, capacity, a certain object, and a lawful cause — consistent with Article 1320 of the Civil Code).

If you act on behalf of a business entity, you warrant that you are authorized to represent it. If you do not agree, please do not use the Services.

4. Accounts, authentication & security

  • You are responsible for keeping account credentials confidential and for all activity under your account.
  • Registration information must be accurate, complete, and up to date.
  • You must promptly notify us if you suspect unauthorized access.
  • We may suspend, limit, or terminate access if we detect violations, security risks, or abuse, in line with policy and applicable law.

5. Permitted & prohibited use

You agree to use the Services only for lawful purposes. You must not:

  • Commit unlawful acts, including ITE Law provisions on illegal access, system interference, or distribution of prohibited information;
  • Upload false, harmful data, or data that infringes third-party rights;
  • Access systems, data, or accounts of others without authority;
  • Disrupt the availability, security, or integrity of the platform;
  • Copy, resell, modify, or reverse engineer the Services without written permission;
  • Use location/SOS features for unlawful purposes or to harm others.

6. Subscription, pricing & payment

  • Features and limits follow the selected plan (for example Lite, Starter, Business) or a special / pay-per-trip arrangement.
  • Prices, fees, term, and renewal are set in offers, invoices, or written/electronic agreements between the parties (consistent with Electronic Contract elements in GR 71/2019).
  • Late payment may result in feature limits or Service suspension.
  • Unless otherwise stated, amounts paid are non-refundable after the Service period starts, without limiting consumer rights guaranteed by law.

7. Customer, pilgrim data & personal data protection

User Content (including pilgrim, transaction, and operational data) you enter into the system remains your responsibility. If you are a travel agency/agent, you act as Personal Data Controller for your pilgrim data and must have a lawful basis under the PDP Law before processing or uploading that data.

Safar Nova processes Personal Data in accordance with the Privacy Policy and the PDP Law. You must ensure pilgrims/members understand the use of location, chat, and SOS features relevant to their journey.

8. Location, SOS & field features

  • Location sharing depends on device permission, GPS, and network connectivity; absolute accuracy is not guaranteed.
  • SOS is an operational notification channel to agents/groups, not a substitute for official emergency services (police, ambulance, or local authorities).
  • In a real emergency, call the official emergency numbers at your location.

9. Service availability & force majeure

We endeavor to operate Electronic Systems reliably and securely in line with the principles of GR 71/2019. However, the Services are not guaranteed to be uninterrupted. Temporary disruption may occur due to maintenance, network issues, third parties, or force majeure beyond our reasonable control.

10. Intellectual property

Safar Nova trademarks, logos, design, code, documentation, and materials are protected by law. You receive a limited, non-exclusive, non-transferable license to use the Services under these Terms. No intellectual property is transferred except by written agreement.

11. Disclaimer & limitation of liability

To the extent permitted by applicable law, Safar Nova is not liable for: indirect or consequential loss; data loss caused by User negligence; or business losses arising from use of or inability to use the Services, except as otherwise stated in a written agreement or required by law (including Consumer Protection provisions that cannot be waived).

Our aggregate liability for claims related to the Services, to the extent permitted by law, is limited to the subscription fees you paid us for the 3 (three) months preceding the claim, unless a written agreement provides otherwise.

12. Suspension & termination

You may stop using the Services at any time. We may suspend or terminate access for material breach of these Terms, security risk, or legal obligation. Provisions that by nature should survive (including IP, liability limits, and governing law) will survive termination.

13. Changes to the terms

We may update these Terms of Use from time to time. Material changes will be announced via the website, app, email, or relevant channels. Continued use after changes take effect may be treated as acceptance, without limiting rights guaranteed by law.

14. Governing law & dispute resolution

These Terms of Use are governed by and construed in accordance with the laws of the Republic of Indonesia. The parties agree to seek amicable resolution first. If unresolved, disputes shall be settled before the competent courts in Indonesia, unless another forum is agreed in writing (for example arbitration).
